Terms of sale


As employed in these Terms and Conditions governing the product sales and use of L'ÉTIQUETTE website, the terms listed here (when written with a capital letter) shall have the following meanings:

- L'ÉTIQUETTE: means the simplified joint stock company L'ÉTIQUETTE, with a capital of €1,000, registered in the Paris Trade and Companies Register under number B 899 213 532, with registered offices at 15 Rue du Ruisseau, 75018 Paris, France.
- Terms & Conditions:
means these General Terms and Conditions of Sale (hereinafter called the T&Cs), which apply to all Products sold by L'ÉTIQUETTE.
- Customer: means a natural or legal person who has bought a product sold through L'ÉTIQUETTE’s online store. If a Customer is a natural person, they must be of legal age and/or legally capable of entering into an agreement.
- Product:
means any item supplied to the Customer by L'ÉTIQUETTE in return for payment.
- Order:
means the act whereby a user and/or Customer expresses their firm intention to buy a Product offered by L'ÉTIQUETTE in return for payment. A user who places an order becomes a Customer.
- Online Store:
means the online mail-order service for buying Products curated by L'ETIQUETTE, accessible at www.letiquette.com.
- L'ÉTIQUETTE Account:
means a private area within the website which users and/or Customers enter by identifying themselves with their login details. There they can access all or some of the Products, and can manage the data associated with their L'ÉTIQUETTE Account. L'ÉTIQUETTE Accounts are accessible at https://letiquette.com/en/account. Customers must read and accept the T&Cs before they can set up a L'ÉTIQUETTE Account.
- Privacy Policy:
means the document setting out how L'ÉTIQUETTE collects and and processes its Customers’ personal data, and the rights that Customers have regarding their own data. The Privacy Policy can be found at https://letiquette.com/en/policies/privacy-policy.

1) Products sold through the online store

- Product Descriptions
L'ÉTIQUETTE makes every effort to provide users and/or Customers with comprehensive information about the Products sold through the Online Store. However, descriptions and visual representations of Products are given for information purposes only and are not contractually binding, meaning L'ÉTIQUETTE cannot be held responsible for any non-compliance with these representations.

- Product Availability
Products are offered for sale in the Online Store subject to availability of stock. They can only be delivered within mainland France, unless otherwise stated in the product details. As far as possible, users and/or Customers are advised about Product availability when they place their Order. However, in the event a Product becomes unavailable after the Order has been placed, L'ÉTIQUETTE will contact the Customer and suggest a replacement Product or, if necessary, cancel the Order and reimburse all sums received by L'ÉTIQUETTE in payment for said Product, excluding any indemnification.

- Retention of Title Clause
The Products offered for sale through the Online Store remain the property of L'ÉTIQUETTE until payment of their sale price has been received in full.

2) Ordering Procedures

To place an Order, Customers must identify themselves on the website via their L'ÉTIQUETTE Account or make a quick purchase without creating an account.

Customers select the Product they want to buy, along with any accessories they may wish to add to their Order. They then enter their shipping and billing information and select a preferred delivery method for their Order.

3) Product Prices

Product Prices are those in effect on the day the Order is placed, as shown in the shopping cart when the Product is selected. Product prices are stated in Euros and are inclusive of all taxes but exclusive of the buyer’s share of costs for handling, postage, and packaging.

If one or more taxes or contributions to costs were to be introduced or modified, this change may be reflected in the sales price of the Products listed in the various sales channels.

All Orders are to be paid for in Euros, regardless of the Customer’s country of residence or the location of the delivery address.

L'ÉTIQUETTE reserves the right to modify the prices of Products while they are on sale, in accordance with the regulations in force at that time. L'ÉTIQUETTE may also decide to run a limited special offer. In no event shall any price fluctuations or special promotion of a Product subsequent to the date of an Order give rise to a claim by the Customer, or entitle them to cancel their Order.

Promotional offers are available for a limited time only and subject to conditions. They cannot be combined with other offers. They cannot be exchanged for their monetary value, nor can they be fully or partially refunded.

If the Customer has a code that could entitle them to a benefit or discount on a L'ÉTIQUETTE Product, this code must be registered at the time of placing the Order. It can only be used once during its period of validity. Codes are issued to named individuals and are non-transferable.

4) Payment

Customers have two payment methods available to them:

- By bank card
Online payment can be made with an accepted bank card via the Stripe secure payment platform. Stripe does not communicate any of the Customer’s financial data to L'ÉTIQUETTE. Confidential data is collected and transmitted in encrypted form on the Stripe servers.

- By Paypal, Google Pay or Apple Pay
Customers can opt to pay by Paypal, Google Pay or Apple Pay. Clicking on “Validate payment” will redirect the Customer to those websites to identify themself and make the payment.

The records of transactions kept by Paypal, Google Pay and Apple Pay will be considered to prove payment was made, unless the user can provide proof to the contrary.

5) Terms of delivery & costs for handling, postage and packaging
Handling and shipping charges are indicated after the delivery address has been entered and before payment is made for any Order. These costs are calculated based on the Product selected, the quantity ordered, and the delivery location.

L'ÉTIQUETTE undertakes to make the Product available to the carrier as soon as possible after payment has been received.

Depending on the type of Product ordered and the delivery method chosen by the Customer, the Product will be mailed by post or transported by an independent carrier to the address indicated by the Customer at the time they placed their Order.

An Order may be delivered in several separate packages, depending on the Products ordered.

Delivery time is at least three (3) working days within mainland France.

Products are delivered to the delivery address indicated by the Customer during the process of placing the Order. It is the Customer’s responsibility to provide accurate and complete information regarding the delivery address so that their Order can be properly executed. Any costs incurred as a result of incorrect information provided by the Customer shall be borne exclusively by them.

If the Customer does not collect their package within the time limit set by the postal services, it will be returned to L'ÉTIQUETTE by the carrier. The Customer may then request either to cancel the Order and be refunded the price of the Order (minus postage or shipping costs), or alternatively to have the Order reshipped at their own expense.

If the Product has not been delivered by the end of a thirty-day period following the date the Order was placed, the sale may be cancelled at the request of either party. The Customer will be refunded the amount of the Order, not including the postage or shipping charges, with no right to compensation.

Pursuant to Article L.217-7 of the French Consumer Code, the Customer has a period of twenty-four (24) months from the date of delivery to obtain redress should the Product delivered not conform to contractual conditions.

6) Legal rights & guarantees regarding product conformity

In the event that the Product delivered does not comply with the Contract as set out in Article L.217-5 of the French Consumer Code, or is broken or damaged when it reaches the Customer, L'ÉTIQUETTE undertakes to send a replacement free of charge.

If the product is an item of clothing and is the wrong size for the Customer, L'ÉTIQUETTE undertakes to send a replacement in another size after the initial item has been returned.

7) “Right to change your mind”

In line with articles L.221-18 and the following articles of the French Consumer Code, the Customer (liable to be defined as a consumer under current regulations) has the right to change their mind and request a refund for an Order placed online.

The right to change your mind must be exercised within fourteen (14) days from the date the Order is received.

Customers who decide to exercise their right to change their mind shall inform L'ÉTIQUETTE in a written communication that unambiguously states their desire to withdraw from the agreement, and gives their bank account details, before the aforementioned fourteen (14) day period has expired.

In the event of a change of mind, any costs relating to the return of the Product are to be borne by the Customer.

8) Applicable law and place of jurisdiction

These Terms & Conditions are governed by French law.

Any dispute arising from the conclusion, execution, or interpretation of this Contract shall come under the exclusive jurisdiction of the Court of Appeal of Paris.
